Child support affects the financial stability of both households and the resources available to meet a child’s needs. Whether you are establishing support for the first time, seeking a modification, or dealing with missed payments, the amount involved should be based on accurate financial information and the requirements of Virginia law.

Virginia’s child support guidelines consider both parents’ incomes, the number of children, the custody arrangement, health insurance costs, employment-related childcare expenses, and other factors that may affect the calculation. When income or expenses are disputed, determining the appropriate amount can become more complicated.

At Randall, McClenney & Daniels, PC, we represent parents in Suffolk child support matters involving establishment, modification, and enforcement. We review the financial information involved, explain how the Virginia guidelines apply, and identify issues that may affect what a parent pays or receives. When the parties cannot resolve those issues, we are prepared to present the case to the court.

How Is Child Support Calculated in Virginia?

Virginia uses statutory child support guidelines to determine how much support should be paid. Under Va. Code § 20-108.2, the calculation begins with the parents’ combined gross income and the number of children covered by the order. Other circumstances may also affect the calculation, including:

  • The income of each parent
  • The number of children
  • The custody arrangement
  • Health insurance costs for the child
  • Employment-related childcare expenses
  • Certain existing support obligations
  • Other financial circumstances recognized under Virginia law

Virginia law recognizes many forms of income when calculating child support. Depending on the circumstances, income may include wages, salaries, commissions, bonuses, severance pay, pensions, investment income, and other sources.

Child custody agreements can also affect how child support is calculated. The guidelines use different calculations depending on the parenting arrangement and the amount of time the child spends with each parent.

Our attorneys can review the financial records and custody arrangement involved in your case and explain how the guidelines may apply.

Which Court Handles Child Support in Suffolk?

Where you file determines which court hears your child support dispute and which procedures apply. Most child support matters in Suffolk begin in the Suffolk Juvenile and Domestic Relations District Court. It hears requests to establish, modify, or enforce an order.

Unmarried parents and separated parents who have not filed for divorce may bring their support matters there. The court reviews both parents’ financial information and applies the guideline. The completed worksheet becomes part of the court record.

When child support is part of a divorce, Suffolk Circuit Court can decide it along with the other terms of the case. Our attorneys handle support matters in both courts and identify where your request belongs.

When Can a Child Support Order Be Modified?

An existing child support order remains in effect until a court changes it. Either parent may seek a modification after a material change in circumstances. Changes in income, custody arrangements, childcare costs, or health insurance expenses may qualify.

A layoff may support a request to revisit the amount. However, the court will examine why the parent’s income changed. A parent who leaves a job voluntarily or is terminated for cause may not receive a reduction because the court can consider that parent’s earning capacity.

Enforcing a Child Support Order in Suffolk

A child support order is a legal obligation. When required payments are not made, unpaid amounts can accumulate, and enforcement action may follow.

Depending on the circumstances, Virginia provides enforcement measures that can include:

  • Income withholding or wage garnishment
  • Interception of certain tax refunds
  • Liens against qualifying property
  • Suspension of certain licenses when statutory requirements are met
  • Contempt proceedings
  • Other court-ordered enforcement measures

Frequently Asked Questions About Child Support in Suffolk, Virginia

Can Child Support Be Ordered If the Parents Were Never Married?

Yes. Both parents must support their child regardless of whether they were married. If legal parentage has not been established, the court may first address that issue through a signed acknowledgment or genetic testing.

How Long Does Child Support Last in Virginia?

Child support usually ends when the child turns 18. It may continue until age 19 or high school graduation when the child is a full-time student, not self-supporting, and living with the parent receiving support. A court may also continue support for an adult child who meets Virginia’s disability requirements.

Can I Get Child Support in Suffolk Without Going to Court?

Sometimes. The Division of Child Support Enforcement can establish support through an administrative process. A court hearing may still be necessary if a parent challenges the result or the case involves issues the agency cannot resolve.
